The right to practice one's religion is enshrined in the U.S. and Florida Constitutions. In the 21st century however, this right can be unduly infringed upon or arbitrarily denied by government officials.

To provide further statutory protection of this constitutional right, the U.S. Congress passed the Religious Land Use and Institutionalized Persons Act (RLUIPA) in 2000.  This law prohibits municipalities, counties and local governments from substantially interfering with the free exercise of a religious institution's religion and practices. Furthermore, RLUIPA prohibits prisons from substantially interfering with a prisoner's free exercise of religion. 

Religious institutions such as churches, synagogues, mosques, and temples of all religions are continually pressured by local governments, by zoning laws and other ordinances. These regulations may attempt to limit traffic flow, regulate noise limitations in residential neighborhoods, control architectural design, limit the building of additions to a church, or ban the practice of religion in a residential home and therefore can substantially interfere with the free exercise of religion. These areas, and many more, are protected under RLUIPA.
